By accessing or using any part of Risorgi—including visiting the site, creating an account, or submitting content—you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not access or use Risorgi.

If you use Risorgi on behalf of an organization, you represent that you are authorized to accept these Terms for that organization. These Terms incorporate by reference any additional policies, rules, or guidelines posted on Risorgi.

1. Definitions

• “Risorgi” (or “we,” “us,” “our”) means our website, platform, and related services, and the entity that operates them.
• “You” means the person or organization using Risorgi.
• “Content” means any text, images, audio, video, or other materials you submit, post, upload, create, or otherwise share on or through Risorgi.
• “RFL-1” or “Risorgi Freedom License” means the specific public license text, version 1, available at /risorgi-freedom-license

2. Your Account

Some features may require an account. You must provide accurate information and keep your password safe. You are responsible for all activity on your account.

You confirm you have the legal right (e.g., you are of legal age) to use Risorgi under your local laws.

We may suspend or terminate your account at any time, with or without notice, for any reason, including (without limitation) a suspected or actual breach of these Terms or applicable law. We may change, withdraw, or restrict features at any time and are not liable for any resulting loss or harm.

3. Your Content & Content Licensing

This section details your responsibilities for your Content, the rights you grant to the public, and the rights you grant to us.

3.1. You Are Responsible for Your Content

You are solely responsible for the Content you submit. You agree not to post anything that is:

• Illegal, harmful, hateful, or deceptive;
• Infringing on anyone’s rights, including copyright, trademark, or privacy rights;
• Invasive of another's privacy;
• Spam, malware, or an unsolicited commercial message; or
• An impersonation of another person or entity.

3.2. Your Representations and Warranties (Your Promise)

By posting Content, you represent and warrant that:

• You own the Content or otherwise have all necessary rights to grant the licenses in these Terms;
• Your Content does not violate the rights of any third party (such as copyright, trademark, patent, privacy, or moral rights); and
• Your Content complies with these Terms and all applicable laws.

3.3. The Public License You Grant (RFL-1)

All Content you submit to Risorgi is automatically and permanently licensed to the public under the Risorgi Freedom License (RFL-1).

This means:

• Anyone may use, copy, remix, and redistribute your Content for any purpose, including commercial, without asking permission or giving credit.
• You keep ownership and copyright over your own original work, but you grant everyone the freedoms listed in RFL-1.
• Others may hold rights over their own contributions, modifications, or additions.

The license is perpetual, worldwide, irrevocable, and royalty-free, and applies both on and outside Risorgi. Do not upload any content unless you have the right to license it under these terms.

3.4. The License You Grant to Us (The Platform)

To operate, secure, and promote Risorgi, you also grant us a separate, worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, adapt (e.g., reformat), display, perform, reproduce, and distribute your Content on and through Risorgi. This license ends when your content is deleted from our systems.

This platform license does not affect the RFL-1 license, which is perpetual and continues even if your content is removed from Risorgi.

3.5. Content Moderation

We are not obligated to pre-screen Content, but we reserve the right to monitor, review, refuse, remove, or disable access to any Content at our sole discretion, at any time, and without notice (for example, if it violates these Terms or the law).

3.6. Legal Compliance

We may preserve and disclose information (including your Content) if required by law, or to enforce these Terms, respond to claims, or protect the rights, property, or safety of Risorgi, our users, or the public.

4. Our Intellectual Property

We own the Risorgi name, logo, design, software, and other materials we create ("Our IP"). Our IP is not released under RFL-1. You may not use our trademarks or other proprietary materials without our prior written permission.

5. Reporting Infringement

Risorgi hosts user-submitted content. We are not responsible for verifying the rights-holder of every submission.

If you believe Content on Risorgi infringes your rights (e.g., your copyright or trademark), please email us at hey@risorgi.com with:

• Your name and contact details.
• A description of the work you believe was infringed.
• A link or enough detail to find the allegedly infringing content.
• A statement that you have a good-faith belief the use is not authorized by the rights-holder, its agent, or the law.
• A statement, under penalty of perjury, that the information is accurate and you are the rights-holder or are authorized to act on their behalf.
• Your physical or electronic signature.

We will investigate and take appropriate action on valid notices.

6. Disclaimers

RISORGI IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT CONTROL OR ENDORSE USER CONTENT AND ARE NOT RESPONSIBLE FOR ITS ACCURACY, QUALITY, LEGALITY, OR RELIABILITY. YOUR USE OF RISORGI AND INTERACTIONS WITH OTHER USERS ARE AT YOUR SOLE RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) RISORGI, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT LEGALLY EXCLUDED, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO RISORGI OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US (IF ANY).

8. Indemnity

You agree to defend, indemnify, and hold harmless us and our contractors, service providers, and affiliates, and our and their respective employees, officers, and directors, from and against any claims, demands, actions, investigations, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of Risorgi; (b) your Content; (c) your violation of these Terms or applicable law; or (d) your violation of any rights of another person or entity.

9. No Responsibility for License Use or User Actions

Risorgi provides the Risorgi Freedom License (RFL-1) as an open licensing framework for contributors and the public. However, we do not mediate, enforce, or verify rights under RFL-1 or any other use of user content.

We are not responsible for:

• How others use or fail to use content licensed under RFL-1;
• Any misuse, misattribution, or legal disputes arising from such use;
• Determining ownership, authorship, or originality of user submissions; or
• Any consequences resulting from publishing or using content on Risorgi.

You agree that your use of RFL-1 and any content on Risorgi is entirely at your own risk.

10. Termination

You can stop using Risorgi at any time. We may refuse, suspend, or terminate all or part of your access to Risorgi at any time, with or without notice, for any reason. We may modify or discontinue all or any part of Risorgi at any time. We are not liable for any change, suspension, or termination, including for any loss of Content.

11. Changes to these Terms

We may update these Terms at any time in our sole discretion. If we make material changes, we’ll post the updated Terms and update the “Last updated” date. Your continued use of Risorgi after the updated Terms become effective constitutes your acceptance. If you do not agree to the updated Terms, you must stop using Risorgi.

12. Miscellaneous

• Entire Agreement: These Terms are the entire agreement between you and us about Risorgi.
• Severability: If part of these Terms is invalid, the rest remains in effect.
• Waiver: If we don’t enforce a term, it doesn’t mean we waive it.
• Assignment: You can’t transfer your rights or obligations under these Terms without our consent. We may transfer ours.
• Third-Party Services: Risorgi may link to or integrate with third-party services that we don’t control. Those services may have their own terms. We aren’t responsible for them.
• Survival: Sections 3, 4, and 6–13 survive any termination of these Terms.
